1. Acceptance
By using Busypus (the “Service”) you agree to these Terms. If you do not agree, do not use the Service. The Service is operated by Andres Canella, an individual based in Miami, Florida, USA (“we,” “us,” or “our”).
2. The Service
Busypus is a meeting-coordination tool. Hosts create meetings, share a link, and guests fill in their availability. The Service is provided “as is” without warranties of any kind. Features may change at any time without notice.
3. Eligibility and accounts
You must be at least 13 years old to use the Service in any capacity, including as a guest. You are responsible for safeguarding your account credentials and for any activity that occurs under your account. You agree to provide a valid email address and to notify us promptly of any unauthorized access.
4. Acceptable use
You may not use the Service to:
- Send spam, phishing attempts, or unsolicited communications
- Harass, threaten, defame, or impersonate other users
- Probe, scan, or test the vulnerability of the Service
- Attempt to circumvent rate limits, access controls, or authentication
- Access the Service via automated means (bots, scrapers, headless browsers) without our prior written permission
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Upload or share content that is illegal, infringes a third party’s rights, or contains malware
- Use the Service for any illegal purpose or in violation of any applicable law
5. User content
You retain ownership of meeting titles, descriptions, nicknames, and other content you submit to the Service (“User Content”). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit it solely for the purpose of operating the Service. You represent that you have all necessary rights to submit any User Content you provide.
6. Intellectual property complaints
If you believe content on the Service infringes your copyright or other intellectual property rights, send a notice to meet@busypus.com including: (a) identification of the work claimed to be infringed; (b) identification of the allegedly infringing content (URL or other reasonable description); (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the rights holder. We will review and act on valid notices in our discretion, including by removing content or terminating repeat infringers.
7. Pricing
The Service is currently free to use. We reserve the right to introduce paid tiers in the future, with notice to existing users before charging any fees.
8. Termination
You may delete your account at any time via the account page, which terminates your access immediately. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we reasonably believe violates these Terms or harms other users or the Service. Sections 9–16 survive termination.
9. Disclaimer
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. We do not warrant that the Service will meet your requirements; that calendar invites, notification emails, or other communications will be delivered without delay or failure; or that meeting data, availability submissions, or finalized times will always be accurate, timely, complete, or preserved without loss. You should not rely on the Service as the sole record of any time-sensitive or business-critical commitment.
10. Limitation of liability
To the fullest extent permitted by law, in no event will Busypus, its operator, affiliates, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Service, even if advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you have paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Busypus and its operator from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any User Content you submit.
12. Governing law and venue
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.
13. Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms, in whole or in part, without restriction—for example, in connection with a sale, merger, or other transfer of the Service. These Terms bind and benefit the parties’ permitted successors and assigns.
14. Severability and waiver
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
15. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements between us on the subject.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms on the Service and updating the effective date above. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
